It is appropriate for employers to provide incentives to employees and their families for participating in wellness programs including:
  • Completing health risk assessment, feedback session, and a personal development plan
  • Accessing an HLC funded personal health coach
  • Meeting the fitness incentive program annual goal

It would be useful to discuss these options with your insurance consultant and proceed with what is best for your company's unique circumstances.  It is important that your employees understand that participation is not optional; participation has specific rewards, non-participation has specific consequences.

From a legal/legislative standpoint, the HIPAA and ADA regulations apply. There is little case law to help us with what is allowable.  Included are examples of companies that have successfully implemented strategies with the guidance of their insurance consultants.

When determining the degree of a consequence, the main guideline to follow is that the incentive/penalty cannot be more than 20% from what applies as the norm.
